Community Service Organisations' Insurance Guide 2011 - 2012

This guide describes the various insurances arranged to provide coverage for nominated CSOs. The policies described in this guide are renewed annually on 30 June each year.

If you are an organisation incorporated within Victoria, with a non-Victorian revenue less than $15,000,000, VMIA is now able to extend the CSO Program to cover ALL your business activities Australia wide for a reasonable additional premium.

Directors and Officers Liability - CSOs

Directors and Officers Liability insurance indemnifies your organisation (including its employees and its Patrons) against legal liability for personal injury and/or property damage claims made against it by third parties that allege their injury or loss was caused by your organisation’s negligence whilst performing authorised activities.

Please note:

There has been a change to the Directors and Officers liability policy wording this year.  The following clause has been added to the policy wording:

5. Employment Practices Violation

5.1 If an Employment Practices Violation Sub-limit is specified in the Schedule for Employment Practices Violations (Public Body), the Authority will indemnify the Officer and the Public Body in respect of any claim (including reasonable professional fees) against it arising out of an Employment Practices Violation. 

Always provided that:

5.1.1 The employment violation was committed in good faith by the insured; and

5.1.2 The insured was not aware of the wrongful nature of such violation and would not have been so aware after making reasonable inquiry, which includes independent external legal advice

Entity Fidelity - CSOs

This section covers your organisation for theft by its employees of money, securities or other property owned by your organisation or in its care custody and control and for which it is legally liable. Employees include volunteers working for you. Cover only applies where the theft takes place and is reported to the VMIA during the currency of the policy or after the “Retroactive Date”. This means there is no cover for any claim that arises from a theft committed before 30 June 2007.

Medical Indemnity  - CSOs

Medical Indemnity Insurance indemnifies your organisation against third party claims resulting from negligence in the provision of health care services which results in bodily or mental injury or death. Please note that you should use your best endeavours to ensure that all consultants and doctors providing medical services for or using your facilities also maintain their own insurance against liability for breach of professional duty.

Personal Accident - CSOs

This section provides income protection and/or capital benefits (including death) to nominated staff and people working on behalf of your CSO in the event the insured person suffers an injury due to accident occurring while performing their duty, including associated travel.

Public and Products Liability - CSOs

Public Liability insurance indemnifies your organisation against legal liability for personal injury and/or property damage claims made against it by third parties. In this situation, they allege their injury or loss was caused by your organisation’s negligence whilst performing authorised activities. Products Liability insurance indemnifies your organisation against claims made against it by third parties that allege their injury or loss was caused by your organisation’s sale, manufacture or distribution, of its products.

Volunteer Care Givers - CSOs

To indemnify people covered by the policy, including volunteers, for property damage caused by acts of malicious damage or theft, or accidental damage directly or indirectly caused by any person or persons under the care of the Person Insured.
