Persons Not Covered
The Government rescue package applies only in very specific circumstances, as set out on the following pages. Many readers will have no cause to go beyond this page, as the information provided here will establish to their satisfaction that the rescue package does not apply to them.
CLAIMS NOT COVERED
- Home warranty certificates of insurance issued after 15 March 2001 will not meet the requirements of the Act and cannot be used. Any claim under such a certificate will not fall within the Government’s rescue package.
- Where building projects had a building permit issued on or after 30 April 2001.
- Where residential building work commenced on or after 31 May 2001.
- Individuals who have had claims completed (either paid or rejected) by HIH/FAI. Such claims will not be reviewed as new claims.
- Claims on dwellings located outside Victoria.
- If another contract of insurance exists for home warranty insurance under which a claim can be made.
PERSONS NOT ENTITLED TO CLAIM UNDER THE RESCUE PACKAGE ARE:
- The builder to which the policy relates.
- A developer to which the policy relates (a ‘developer’ is a client of a builder where the work involves 3 or more dwellings or a retirement village or accommodation specially designed for the disabled).
- The individual who was an owner builder.
- Certificate of insurance issued by HIH and/or its former Agents and Brokers after 15 March 2001.
- Building work for which a building permit was issued after 30 April 2001.
- Work that had not commenced prior to 31 May 2001.
